Nab le.~~- <br />~~~~~~ <br />Clarifications to Planned Unit Development Agreement #1364 with <br />Cent Ventures LLC <br />1) Section 9.14, Development Fees- This section stipulates that the Developer will pay its <br />proportionate share of infrastructure costs as identified in the Infrastructure Improvements <br />for the Twin Lakes AUAR dated February, 2008 prior to the issuance of building permits. <br />The Developer would like the record to reflect that staff is studying concepts that, if <br />recommended and approved by council, could allow for a special assessment of the <br />Infrastructure Improvements as a potential alternative to full payment at the time of building <br />permit. <br />2) Section 9.15, Temporary Access- this section stipulates that the Developer will construct a <br />20' wide, all weather temporary emergency access road within the Mount Ridge Road right- <br />' ~~ ~ of-way from the subject parcel to County Road C. The Developer would like the record to <br />,~ reflect that the city engineer, Duane Schwartz, has agreed that the Developer is required to <br />ensure that there is secondary passage adequate from County C to allow for emergency <br />~' ~ vehicles to access the site at all times. The existing road may be used, where adequate, and <br />~~~f will not require that an entire roadway be constructed. In addition, the use of future Iona lane <br />will be adequate as a secondary access when it is completed. The Iona Lane project will be <br />presented as part of the Old Dominion concept PUD package to be submitted within the next <br />2-3 weeks. <br />3) Section 9.18, Final right of way/Public Easements- This section stipulates that the Developer <br />will cooperate with the city engineer to complete the final Plat of the Twin Lakes Parkway <br />and/or Mount Ridge Road right-of--way location. The Developer would like the record to <br />reflect that the acquisition cost of the final right-of -way is included in the Twin Lakes <br />AUAR Infrastructure Improvements study dated February, 2008 page 4. <br />
