Approve Midland Hills Country Club's Request for aRight-of-Way Vaca-
tion for an Undeveloped Portion of Walnut Street between Ryan Avenue,
State Highway 280 and the Golf Course (PF08-009) (Former Consent Item
7.e)
City Manager Bill Malinen briefly reviewed the request, in accordance with the
staff report dated May 19, 2008.
Councilmember Ihlan questioned if there was an applicable fee for vacation of a
right-of--way, since it was technically a form of public property; and if the City
were required to acquire property for aright-of--way, it would require payment to
the property owner.
City Engineer Debra Bloom advised that the right-of--way was dedicated as part of
the property owner's plat, and when vacated the City was simply absolving their
interest in the right-of--way; could not sell the right-of--way to anyone else; and
that there was no applicable fee for such a vacation.
