Statement Regarding Department of Administration Opinion
Mr. Mayor, Councilmembers:
Late Friday afternoon, we received a courtesy copy letter from the
Department of Administration responding to a request for an
opinion made by Mr. John Kysylyczyn.
Mr. Kysylyczyn's request for an opinion was centered on whether
an a-mail message I had sent to the City Councilmembers should
have been printed and provided to the public as a part of the
meeting materials. I had not done so.
The letter we received last Friday included an analysis and opinion
of the Commissioner that the City did not comply with the
requirements of the open meeting statute because we did not
provide a copy of the email for the public.
I want to accept responsibility for this oversight, and apologize to
the City Council and Roseville citizens.
The situation that was in question was one where a printed copy of
an a-mail I sent to the Councilmembers on the morning of a
meeting was not included in the public meeting materials, and
frankly I was unaware that it was required.
This was a mistake on my part. I had no intent or design to
withhold the email or its content from the public. I believe that all
aspects of the memo were, in fact, disclosed to the public during
the City Council discussion, but a printed copy of the email was
not available at the meeting.
In the future we will provide such information before or during a
council meeting.
Bill Malinen, Roseville City Manager
