EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 25th day of August 2008, at 6:00 p.m. <br />The following members were present: Ihlan, Pust, Roe, Willmus, Klausing; <br />and none were absent. <br />Council Member Klausing introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 10649 <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />WITH §1005.015 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR ROSEVILLE <br />PROPERTIES AT 2575 FAIRVIEW AVENUE (PF08-031) <br />WHEREAS, Roseville Properties owns the property at 2575 Fairview Avenue; and <br />WHEREAS, the subject property is legally described as: <br />Rosedale Industrial Park Lot 3 Block 1 <br />PIN: 09-29-23-21-0009 <br />WHEREAS, through the applicant, Allen Lenz, the property owners seek to allow a <br />motor vehicle dealer, which is a conditionally permitted use in the applicable General Business <br />Zoning District; and <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />requested CONDITIONAL USE PERMIT, voting 7-0 to recommend approval of the request <br />based the comments and findings of the staff report dated August 6, 2008; and <br />WHEREAS, the Roseville City Council has determined that approval of the requested <br />CONDITIONAL USE PERMIT will not adversely affect conditions on, or value of, nearby <br />properties and will not compromise the health, safety, and general welfare of the citizens of <br />Roseville; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request for a CONDITIONAL USE PERMIT in accordance with Section § 1013.01 of the <br />Roseville City Code, <br />a. Motor vehicles sold shall be those that require state registration, license plate, and <br />driver's license, and shall be further limited to neighborhood electric vehicles as <br />defined in MN Stat. 169.01 subd. 91, motorized bicycles as defined in MN Stat. <br />169.01 subd. 4a, electric-assisted bicycles as defined in MN Stat. 169.01 subd. 4b, <br />and motorcycles as defined in MN Stat. 169.01 subd. 4 which nominally do not <br />exceed 250cc of piston displacement capacity; <br />Page 1 of 3 <br />
