Regular City Council Meeting <br />Monday, August 25, 2008 <br />Page 18 <br />Trudgeon noted the underlying zoning to PUD with underlying R-3 designation; <br />access from Cleveland as part of a public road though the property to the south- <br />east and Langton Lake Park. <br />Mr. Trudgeon corrected one discrepancy in the staff report, correcting the road- <br />way width to be 26 feet wide up to the parking lot/crosswalk, then 32 feet from <br />that point at the curve into the park. <br />Mr. Trudgeon addressed stormwater management to be contained on site; and <br />several remaining issues to be resolved related to the road width; and provision <br />for a turnaround, with City Code prohibiting a roadway without turnaround, given <br />the length of the road. Mr. Trudgeon advised that the City Council may want to <br />seek more specificity by either requiring the turnaround on-site or off-site (i.e., <br />cul-de-sac) to accommodate emergency vehicles; and also to define the park dedi- <br />cation, and whether the developer would be charged since the road would be for <br />public use and access to a City park, currently landlocked and without controlled <br />access. <br />Discussion included building height and CUP requirements for astand-alone <br />building; height deviations from City Code; no restrictions for impervious surface <br />related to commercial developments; anticipated land use designation in the <br />Comprehensive Plan Update to high-density residential; and road length exceed- <br />ing 600' even with a turnaround provided. <br />Councilmember Ihlan sought clarification of a procedural point regarding ap- <br />proval of the preliminary plat, and ordinance language, Title 1102.01, appearing <br />to indicate that if the final plat application was not received within a time period <br />certain, the application would have expired, and the process needed to go through <br />the application and Planning Commission process again. <br />Mayor Klausing sought a ruling from City Attorney Anderson related to Coun- <br />cilmember Ihlan's interpretation of the ordinance and whether the application <br />needed to be resubmitted. <br />Staff advised that there had been no formal request for extension by the applicant, <br />but that they were following normal procedure, and that the process between pre- <br />liminary and final plat approval was often lengthy. <br />City Attorney Anderson deferred rendering a legal opinion without a thorough re- <br />view of City Code language and a history of the project to-date to allow him to <br />make that determination. <br />Recess <br />Mayor Klausing recessed the meeting at 8:43 p.m. to provide staff and City Attorney Anderson <br />to review the project status. The meeting was reconvened at 9:02 p.m. <br />
