Regular City Council Meeting <br />Monday, August 25, 2008 <br />Page 24 <br />Discussion included research materials of the League of Minnesota Cities (LMC) <br />and those available from other communities (Cities of Minnetonka and Renville, <br />MN). <br />City Attorney Anderson provided his perspective on the need for further defini- <br />tion, such as what was included in "expansion" language, and what constituted <br />expansion in anon-conforming use. Mr. Anderson advised that his firm had at- <br />tended legislative hearings, and had obtained transcripts of legislative committee <br />meetings to hear discussion and rationale for proposed changes, and to determine <br />their intent. Mr. Anderson reviewed the legislative purpose and apparent problem <br />they were attempting to fix, based on a specific lakeshore property in northern <br />MN and potential replacement of the structure that had been destroyed. Mr. <br />Anderson noted that the court system had yet to deal with issues created from this <br />new policy, rather than past language supporting gradual elimination of non- <br />conformities through catastrophe. <br />Councilmember Pust noted the preference for a policy discussion before court ac- <br />tion to determine the solution. Councilmember Pust recognized the City's en- <br />couragement for continued updating of its housing stock, rather than use of odd <br />gyrations to conform and case by case interpretations, and to eliminate situations <br />to exist when people no longer know what the rules mean. <br />Mayor Klausing thanked Councilmember Pust for bringing this issue forward. <br />Councilmember Pust advised that she would frame up policy discussions, and <br />proposed action items for further discussion at a future meeting. <br />Councilmember Roe suggested, with Council consensus, that the Planning Com- <br />mission be involved in the discussion to provide their comment and perspective. <br />14. City Manager Future Agenda Review <br />City Manager Malinen reviewed upcoming Council agendas for the next few months. <br />Councilmember Pust advised her need to know as soon as possible, the scheduling of in- <br />terviews of Housing and Redevelopment Authority applicants to allow scheduling on her <br />part. <br />15. Councilmember-Initiated Items for Future Meetings <br />Councilmember Ihlan sought an update from staff on the Centennial Commons issue <br />soon; including a status report on whether bonds have been issued or not. Mayor Klaus- <br />ing updated Councilmembers on the resident attorney's lack of follow-up with him, when <br />Mayor Klausing had extended an invitation to him to contact him for further discussion <br />following public comment at the last Council meeting. Mayor Klausing advised that he <br />would attempt to make contact with the attorney. <br />
