Regular City Council Meeting <br />Monday, November 24, 2008 <br />Page 16 <br />made for retaining incumbent prosecuting attorney rather than changing firms, <br />and how that would best benefit the City; who would the City Manager choose as <br />a second choice for prosecuting attorney and rationale for that choice; all in re- <br />spect to the City's current policy and rationale for not providing others with an <br />opportunity to work with the City of Roseville. <br />City Manager Malinen was given the same request for civil legal counsel, includ- <br />ing providing a better understanding of how ratings worked and their ranges for <br />each category. <br />Councilmember Ihlan opined that the City Council should have much more input <br />in the City Attorney selection, given the extensive direct work with the City <br />Council. <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn, provided his historical perspective for instituting such a policy <br />in 1998/99 and suggested that the City Council review former Councilmember <br />Dean Maschka's rationale for the policy. Mr. Kysylyczyn opined that misde- <br />meanors occurred everywhere, and smaller firms could serve the City equally as <br />well as incumbents; and suggested that large cases in law enforcement were han- <br />dled by the County Attorney, not the City's prosecuting attorney. <br />Mr. Kysylyczyn expressed concern with the make-up of the panel used for rank- <br />ing the prosecuting attorney, in relation to the make-up of the panel used for rank- <br />ing the civil attorney; alleging that the militaristic organizational structure of the <br />Police Department with two (2) of the panelists being direct reports to their su- <br />pervising officer, the Police Chief, was less independent than the panel used for <br />evaluating the civil attorney. <br />Mr. Kysylyczyn expressed further concern regarding the lack of follow-up on low <br />bidders and similar language of previous evaluations of legal firms. <br />Police Chief Carol Sletner <br />Chief Sletner clarified that, during the scoring process for prosecuting attorney, <br />each panelist (consisting of her, Captain Mathwig and Lt. Lorne Rosand) had <br />scored and ranked firms secretly and individually, with no exchange of scores at <br />any time, as alleged in previous comments of Mr. Kysylyczyn. <br />A bench handout had been provided by the City's civil legal counsel, supplement- <br />ing their Civil Legal Services proposal, and in light of current economic condi- <br />tions and the City Council's effort to minimize the levy increase for the 2009 City <br />budget, offering to freeze the 2009 retainer at 2008 levels. <br />14.
