R1DER � TO RETAfL LEASE <br />Dated December 30, 1999, by and between LEX![�GTQN S�-fOPPES LIMITED PARTNERS�{IP, as <br />Landlord and the City of Ros��ilfe, as �en�nt: <br />1. Additianal Term. The Rent for eaeh Lease Y��r during the Term hereo€ shall be payable in <br />twelve (12) egual rnonth�y ir�stallments on or before the first day of each month, in advance, <br />in �he foflowing amounts : <br />�.ease Month Monthlv Rent <br />1 -36 $ 2,OQ0 <br />2. Separate Meterinc�of._Utilities. Utifity service for electricity, heat, telepl�one or cable shali <br />be a direct rsposibili�y of the Tenant. <br />3. Buildir�g Signage. Tenant shall b� responsible for all costs associated with Tenant's <br />exterior signage. ��nants �ignage rnust canply with all City codes and regulations ancf such <br />requiremer�ts that may be stipulat�d by the Landlord herein and be ir�stafled in accordance <br />with �he rehabilitation timetable of t�e Shopping Center. Upon Lease termination, Tenant wiEl <br />have the right to �emporary signage at Tenant's cost of at least 4 squrae feet in size for a <br />period not to exceed one year infofs��ing Ter�ant's customers o# its new iocation. The sign <br />will be located as clase as possil�le to the premises doorway. <br />4. Option to Ex�end Lease Term. Provided Tenant is not in default hereunder, Tenant shall <br />have the option ta extend the term of this lease for twa (2} three year periods upon the <br />same terms and condit�ons except fo� Month�y Ren�, which for the option p�riod shall be <br />$2,083 per mont� for the �irst three-year extension term and $2,500 per rrkonth for the <br />second three-year ex[ensior� term. �enant shall �xercise said option by giving written n�tice <br />to Landlord nat later thar� 60 days prior to the ex�iratian of the then current Lease Term. <br />5. Parkin� Lot. Landlord agrees to �xtencl the parl<ing lot to the north (subject t� the <br />approval of tha City of Roseville's h�IIiCII�1C� d�partment) to pra�ide at a minimu�n an <br />additianaf 24 parking s�aces. �his parl<ing lot exter�sion is to be comp�eted within 12 <br />months of the Tenants written rec�uest to proceed. Upon cor�pletion, Tenant agrees to <br />reimburse the �andlord for SO% af the cost of such extension. Suc� payment ta be made <br />by Tenant within 1 5 days of r�c�i{�t of invoice from Landlord. <br />6, EJ� aid sums and Service Char es. Any amounts owing from the Tenant to the LandEord <br />ur�der this L�ase shall bear int�rest at the De�ault rate. In addiiion to the foregoing <br />remedies, if any payment of Ann�fa( Rent is not paicl when d�e, Tenant shall pay a late ci�arge <br />equal ta 5% of the amount af such overdue payment as liquidated damages for the <br />Landlord's extra exper�se ar�ci handlinc� of such past cfue amount. <br />77 <br />
