BOERSCIiEL <br />At the request of ihe Board af Dixectors, I am writing to summariz� the allocation of <br />costs for maintenance of roofs, gutters, downspouts, exteriox siding a�d other bui.lding <br />surfaces on th� t�wnhouses in Westwood Village. <br />The alloca�on of costs is goverried �y the Second Amended Declaratron �or Common <br />Inferest �a�znuz�ity No. 727, Wes#wood Village, reco�rded xn the �ta.rt�sey Ca�nty <br />Recorder's Offiee as Document Nwnber 4093011. The Second Aix�ended Deciaxation <br />was validly adopted p�rsuant to the requirements af Minnesata S�at�tes Chapter 51 SB <br />(t�e Miunesata Cammon Ir�terest Ownership Act} and pursuar�t to the requirements of �e <br />prior Deciaration. Th� Seco�d .Arnended DecIaration is binding upon and enforcea�le by <br />th� Soard and the Unii Owners. The Direciors are legally obl�gated to comply with fl�� <br />allocation of costs �stablished in the �eco�d Amendec� D�claration, aud failure to do so <br />couId res�lt in a Iaws�it by one ar more Unit Owners against the Ass�ciatian and agav�st <br />the mernbers of-f.i�e �oarcl-o� Direc�ors in fl�eir individual capacity. <br />Section 9.1.2 requires tile Association to main�ain, re�aix and replace roofs, gutters, <br />downspouts, exterior sidi�g and othex building surfaces on #�e Dw�llir�gs. The related <br />costs are Cor�man Expenses as de�xned in S�e�ion 1.8. <br />S�ction 4.2 allocates Coin�ztan E�p�nse obligatio�s equally atnong the Ui�ts, with each <br />Unit being allocated 1i�7`�' of the Conunon Expense obligations, su�ject to Seetion 5.�. <br />Section 6.4.1 addresses the cast of n�ainta�u�g Li�n�ted Co�lunon Elements. Section 6.4.1 <br />doES nat apply to t11e cost of maintaining raofs, gutters, downspouts, exteriar sidi�ig and <br />at��er buildii�g su�•faces, becavse tl�ey are not Li�nited CQt��i�on Eleine�ts.
