This is a sample declaration. The actual declaration should be drafted by the Public Entity or the Public Entity's attorney and include the language provided. The legal description in Exhibit A to this declaration should be the same legal description listed in Attachment II to this grant agreement and should only include the restricted, public property. The completed declaration must be recorded by the county and a recorded copy must be submitted to DEED prior to disbursement of funds. Attachment I to Grant Agreement DECLARATION The undersigned has the following interest in the real property legally described in Exhibit A attached and all facilities situated thereon (cumulatively referred to as the "Restricted Property"): ❑ ❑ ❑ (Check the appropriate box a fee simple title, a lease, or an easement, and as owner of such fee title, lease or easement, does hereby declare that such interest in the Restricted Property is hereby made subject to the following restrictions and encumbrances: A. The Restricted Property is bond financed property within the meaning of Minn. Stat. § 16A.695 that exists as of the effective date of the grant agreement identified in B hereinbelow, is subject to the encumbrance created and requirements imposed by such statutory provision, and cannot be sold or otherwise disposed of by the public officer or agency which has jurisdiction over it or owns it without the approval of the commissioner of the Minnesota Department of Finance, which approval must be evidenced by a written statement signed by said commissioner and attached to the deed or instrument used to sell or otherwise dispose of the Restricted Property; and B.
