The Second Amended Declaration <br />was validly adopted pursuant to the .requirements of Minnesota Statutes Chapter 51 SB <br />(the Minnesota Common Interest Ownership Act) and pursuant to the requirements of the <br />prior Declaration. The_Second Amended Decl *ation is binding upon and enforceable by <br />the Board and the Unit Owners. The Directors are legally obligated to comply with the <br />allocation o costs e s e in the Second Amended Declaration, and ' n_*r to ~ co <br />co resu t in a awsult y one orb Dore IInit Owners agalnst the Association and against <br />t e - s ~ e ar _a uectors to elr in vt capacity. y <br />Section 9.1.2 requires the Association to maintain, repair and replace roofs, gutters, <br />downspouts, exterior siding and other building surfaces on the Dwellings. The related <br />costs are Common Expenses as defined in Section 1:8. <br />Section 4.2 allocates Common Expense obligations equally among the Units, with each <br />Unit being allocated 1 /471h of the Common Expense obligations, subject to Section 6.4, <br />Section 6.4.1 addresses the cost of maintaining Limited Common Elements. Section 6.4.1 <br />does not apply to the cost of maintaining roofs, gutters, downspouts, exterior siding and <br />other building surfaces, because they are not Limited Common Elements.
