EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 18~' day of May 2009 at 6:00 p.m. The following members were present: Roe, Johnson, Ihlan, Pust, and Mayor Klausing and the following were absent: none Council Member Johnson introduced the following resolution and moved its adoption: RESOLUTION NO.10708 A RESOLUTION APPROVING THE VACATION OF CERTAIN PUBLIC RIGHT-OF- WAY ON PROPERTY LOCATED AT 2750 CLEVELAND AVENUE (PF09-012) WHEREAS, Old Dominion Freight Line, Inc. has requested the VACATION of CERTAIN PUBLIC RIGHT-OF-WAY that lie on their property located at 2750 Cleveland Avenue and pursuant to the Vacation and Rededication Agreement dated December 15, 2008; and WHEREAS, the Public Works Department has determined that the existing right-of--way can be vacated pursuant to the Vacation and Rededication Agreement; and WHEREAS, said following PUBLIC EASEMENTS are to be vacated in their entirety: The Northerly Ten (10) feet and Easterly Ten (10) feet of Outlot A, Twin Lakes Addition, according to the recorded plat thereof, Ramsey County, Minnesota. WHEREAS, on May 6, 2009, the Roseville Planning Commission held the duly noticed public hearing regarding the PUBLIC RIGHT-OF-WAY VACATIONS and voted (6-0) to recommend approval of based on the information contained in the project report dated May 6, 2009; NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the VACATION of certain PUBLIC RIGHT-OF-WAYS on property addressed at 2750 Cleveland Avenue. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Roe, and upon vote being taken thereon, the following voted in favor: Roe, Johnson, Ihlan, Pust, and Mayor Klausing and the following voted against: none WHEREUPON said resolution was declared duly passed and adopted.
