Chapter 1014 is hereby amended as follows: <br />1014.01: 1015.03: FEES <br />• To defra administrative cost or rocessin a li <br />Y p g pp cations for rezoning, variances, conditional use permits, <br />°°'''°°'~ „°~~+~ administrative deviations, vacations of streets or alleys, or building location, a fee shall <br />be paid by the applicant in an amount set by the City Council and kept on file in the city manager's <br />office. Fees shall be payable at the time applications are filed with the city manager and are not <br />refundable unless application is withdrawn prior to referral to the planning commission. (Ord. 1223, 6- <br />29-1999) <br />1014.02: 1.015.04: BOARD OF ZONING ADJUSTMENTS AND APPEALS <br />C. Appeals. An appeal to the City Council, acting as the Board of Adjustment and Appeals, from <br />the Variance Board or an administrative ruling of the Community Development Director or <br />l~is~her-designee regarding any interpretation of the intent of this Title or Title 11 of this code, or <br />any action approving or denying an application related to any matter addressed in this Title or <br />Title 11 of this code may be filed in writing by any property owner or their agent with the city <br />manager within ten (10) calendar days after the making of the order or decision being appealed. <br />2. The written appeal shall state the specific grounds upon which the appeal is made and shall <br />be accompanied by a fee established by resolution of the City Council. A public meeting <br />regarding the matter shall be held before the Board of Adjustment and Appeal at a regular <br />meeting held within 30 days of the receipt of the required written appeal. <br />a. Variance Appeals: A mailed notice of the public meeting at which the appeal is to be <br />considered shall be sent to members of the Variance Board ~;r °rr'~°°'''°~ and to all of those <br />• property owners within X3&500 feet of the subject property as well as the owner and tenants <br />(if any) of the subject property. Administrative Deviation Appeals• A mailed notice of the public meeting at which the <br />appeal is to be considered shall be sent to all of those property owners who received notice of <br />t_he original administrative deviation hearing as well as the owner and tenants (if any of the <br />subject property_ <br />SECTION 4.
