S.P. 6241-51 (T.H.280) <br />Mn/DOT Agreement Number 92042 <br />Ramsey County <br />1 <br />2 B) Limitation on Payment <br />3 <br />4 1) The total amount the State is required to pay the City is limited to the amount <br />s shown in Article V.A.2. <br />6 <br />7 2) If the City deems it necessary to perform additional work not covered by this <br />8 Agreement, or anticipates costs exceeding the amount shown in Article V.A <br />2 <br /> <br />9 . <br />., <br />then the City must promptly notify the Utilities Engineer, in writing, prior to <br />to performing that additional work or incurring those additional costs. The written <br />11 notice must describe the nature and cost of the additional work and provide <br />12 reason(s) to support the request. The Utilities Engineer may approve the <br />13 request subject to the availability and encumbrance of necessary funds. If the <br />14 City performs additional work for which the State has not previously <br />1 s encumbered funds, the State is not obligated to pay for that work. <br />16 <br />17 3) If the amount the City requests under Article V.B.2. does not exceed 10 percent <br />is of the amount in Article V.A.2., the City may begin the additional work upon <br />19 notification from the State that it has approved the work and encumbered <br />20 additional funds. The State may authorize payment of that pre-approved <br />21 additional amount without amending this Agreement. <br />22 <br />23 4) If the amount the City requests exceeds 10 percent of the amount shown in <br />24 Article V.A.2., this Agreement must be amended to reflect the new cost before <br />2s the State will be responsible for paying that additional cost. <br />26 <br />27 VI. Audits <br />28 <br />29 A) Pursuant to Minnesota Statutes, section 16C.05, subdivision 5, the City's accounting <br />30 :books, records, documents, procedures, and practices that are relevant to this <br />31 Agreement are subject to Legislative or State Audit for a minimum of six years after <br />32 this Agreement expires. <br />33 <br />34 B) The City must respond to requests for audit information to support claimed costs no <br />35 later than 60 days after receiving the requests or the State will cite all costs in question. <br />36 If the City does not respond during this 60-day period, the State will consider the audit <br />37 citations accepted and will make payment accordingly. <br />38 <br />39 <br />Page 7 of 11 <br />
