S.P. 6241-51 (T.H.280) Mn/DOT Agreement Number 92042 Ramsey County 1 2 B) Limitation on Payment 3 4 1) The total amount the State is required to pay the City is limited to the amount s shown in Article V.A.2. 6 7 2) If the City deems it necessary to perform additional work not covered by this 8 Agreement, or anticipates costs exceeding the amount shown in Article V.A 2 9 . ., then the City must promptly notify the Utilities Engineer, in writing, prior to to performing that additional work or incurring those additional costs. The written 11 notice must describe the nature and cost of the additional work and provide 12 reason(s) to support the request. The Utilities Engineer may approve the 13 request subject to the availability and encumbrance of necessary funds. If the 14 City performs additional work for which the State has not previously 1 s encumbered funds, the State is not obligated to pay for that work. 16 17 3) If the amount the City requests under Article V.B.2. does not exceed 10 percent is of the amount in Article V.A.2., the City may begin the additional work upon 19 notification from the State that it has approved the work and encumbered 20 additional funds. The State may authorize payment of that pre-approved 21 additional amount without amending this Agreement. 22 23 4) If the amount the City requests exceeds 10 percent of the amount shown in 24 Article V.A.2., this Agreement must be amended to reflect the new cost before 2s the State will be responsible for paying that additional cost. 26 27 VI. Audits 28 29 A) Pursuant to Minnesota Statutes, section 16C.05, subdivision 5, the City's accounting 30 :books, records, documents, procedures, and practices that are relevant to this 31 Agreement are subject to Legislative or State Audit for a minimum of six years after 32 this Agreement expires. 33 34 B) The City must respond to requests for audit information to support claimed costs no 35 later than 60 days after receiving the requests or the State will cite all costs in question. 36 If the City does not respond during this 60-day period, the State will consider the audit 37 citations accepted and will make payment accordingly. 38 39 Page 7 of 11
