Vlr. Bi Malinea
Mr. Pat Trudgeon
April 3, 2009
Page 2
conditions, or abandanment, consttutes a frre hazard or a hazard to
public safety or health.
Minn. Stai. § 462.15.
The Hazardaus Building Law process is a judicial prcess involving the districi: court:
Ultimately, if the court approves the removal or abatement af the hazardous building, the costs
of removal may b assessed against the property (along with attorneys' fees}.
Option TYree iraould invoive an outrrght condemnation of the property. Given the likely
nature of such an action in Twin Lakes, an outright condemnation would presumably require
the City to demonstrate that the canditions of "blight" eXisted, or that the building was
"structurally substandard" as these terirs are defned in Minn. Stat. § 1] 7:025.
I hope this at least preliininaril addresses the questions raised b the Council. Let us
know if you nEed further inforination.
Regards,
Jay T, quires
JTS/serr►
RRM: # 1298 ] 2
