Department Approval <br />Item Description: <br />BACKGROUND <br />l�'�, <br />Jy <br />REQUEST FOR COUNCIL ACTION <br />Date: 06-15-09 <br />Item No. : 12. d <br />City Manager Approval <br />� / <br />Community Development Department Request to issue a Ramsey County <br />Court Citation for Unresolved Violations of City Code at 2174 Snelling <br />Avenue. <br />• The subject property is a multi-tenant commercial property. <br />• The current owner is Mr. Todd Young who operates an attorney office out of this property. <br />• Violations include: <br />An inoperable and severely damaged vehicle, constituting a public nuisance, has been <br />placed in-front of Mr. Young's Law Office in a landscape area (a violation of City Code <br />Section 407.02.0). <br />• Mr. Young claims the vehicle is `evidence' and refuses to remove it. <br />• A status update, including pictures, will be provided at the public hearing. <br />POLICY OBJECTIVE <br />The City goals within the Comprehensive Plan are to protect and improve property values (Goa13, 4, <br />and 5; page 6 and, Section 3) and to adhere to performance standards which protect the integrity of the <br />housing units and the neighborhood (Policy 6, page 8, Section 3). <br />FnvaNCiaL IlviracTs <br />Because Mr. Young claims the vehicle is evidence, its removal (impounding) by the City could involve <br />the City in litigation. <br />A court citation would not result in additional cost for the city as the prosecuting attorney performs <br />these cases as part of their contract. <br />STAFF RECOMMENDATION <br />Staff recommends the Council direct Community Development staff to issue a Ramsey County Court <br />Citation to Mr. Todd Young to ensure he abates the public nuisance as soon as possible. <br />REQUESTED COUNCIL ACTION <br />Direct Community Development staff to abate the public nuisance at 2174 Snelling Avenue by issuing <br />a Ramsey County Court Citation to the owner. <br />Page 1 of 2 <br />
