Twin Lakes TIF District No. 17 <br />Page 2 of 6 <br />June 9, 2009 <br />MINNESOTA STATUTE 469.174, SUBDIVISION 10 REQUIREMENTS <br />The properties were inspected in accordance with the following requirements under <br />Minnesota Statutes, Section 469.174, Subdivision 10(c), which states: <br />Interior Inspection <br />"The municipality may not make such determination [that the building is structurally substandard] <br />without an interior inspection of the property..." <br />Exterior Inspection and Other Means <br />"An interior inspection of the property is not required, if the municipality finds that <br />(1) the municipality or authority is unable to gain access to the property after using its best <br />efforts to obtain permission from the party that owns or controls the property; and <br />(2) the evidence otherwise supports a reasonable conclusion that the building is structurally <br />substandard." <br />Documentation <br />"Written documentation of the findings and reasons why an interior inspection was not conducted <br />must be made and retained under section 469.175, subdivision 3(1)." <br />June 2009 Process <br />In 2005, every one of the buildings found substandard in TIF District No. 17 was inspected on the <br />interior and e�terior. It did not seem practical to re-inspect every building interior for the 2009 <br />analysis, so we asked City staff to pull all building permits for any building within TIF District <br />No. 17. Our assumption was that if a property owner improved a building between our <br />inspections in May of 2005 and now, they would have filed for a permit at City Hall. <br />We found that six building permits had been filed since June of 2005 within TIF District No. 17, <br />but only one permit involved a building found substandard in 2005. The building at 2814 <br />Cleveland Avenue North (TIF 1-3) received some minor electrical work, which would have had <br />minimal, if any impact on our substandard findings. <br />Taking into account the fact that property owners might have made improvements to their <br />buildings without going through the legal permitting process, we conducted exterior inspections <br />and took photographs of each building in TIF District No. 17 to see if any apparent improvements <br />had been made to the buildings. Our visual observations and comparisons of 2005 to 2009 photos <br />confirmed that no investments or improvements have been made to the substandard buildings <br />within TIF District No. 17. In fact, it appears that the buildings have deteriorated significantly <br />since June of 2005 (See Diagram 1 example). <br />
