Attachment B <br />WHEREAS, Petitioner has commenced condemnation proceedings to acquire the <br />Property, but the Petitioner has need of immediate title and possession of the Property to <br />facilitate public roadway improvements on the Property; and <br />WHEREAS, Petitioner's Petition for condemnation includes acquisition of fee <br />title, and temporary construction easements over, under and across the Property for a <br />period of one year; and <br />WHEREAS, it is the desire of the parties hereto that this Agreement reflect the <br />total understanding between them for the present conveyance of title to the Property to <br />Petitioner and the immediate transfer of possession thereof to the Petitioner to <br />accommodate said public roadway improvements; and <br />WHEREAS, it is the desire of the parties to provide for the deposit of the <br />Petitioner's approved appraisal of value of $61,000 to the Ramsey County District Court <br />as present consideration for the taking of the Property with the understanding that the <br />actual consideration to be paid by the Petitioner shall be determined in said condemnation <br />proceedings. <br />NOW, THEREFORE, IT IS AGREED AND STIPULATED by and between the <br />parties hereto as follows: <br />Respondent Pikovsky Management, LLC, hereby stipulates to the public <br />purpose of the acquisition by the Petitioner of the Property and the construction easement <br />and the condemnation proceeding that has been commenced by the Petitioner with <br />respect thereto. <br />2 <br />
