4.O BACKGROUND � 4.1 Mr. Plumb owns the property addressed as 501 South McCarrons Soulevard, located at � the intersection of Roselawn Avenue with North and South McCarrons Soulevards. Mr. � Plumb's property has a Comprehensive Plan designation of Low-Density Residential � (LR) and a zoning classification of Single-Family Residence District (R-1). 4.2 This request stems from Mr. Plumb's plans to make some modifications to his home. 5.O STAFF COMMENTS � 5.1 The subject land area appears to have been included in a Supervisor's Road Order, dated � May 19, 1887, creating a public highway. Although neither Ramsey County nor the City � of Roseville currently identifies the subject land area as public right-of-way (xow), the � City's records contain no indication that this portion of the "public highway" was ever � formally vacated; this is why the City is now being asked to consider vACATiNG any � interest in this property. _ 5.2 When reviewing requests for vacating a public xow, the Public Works/Engineering _ Department determines whether the request will, immediately or in the future, have an _ adverse impact the general health, welfare, or safety of the citizens of the City of _ Roseville. The Public Works Director has reviewed and approved the survey and legal _ description of the land area to be vacated and has determined that the interests of the _ public will not be compromised by vACATiNG this portion of South McCarrons � Soulevard xow. The site plan included with this staff report (Attachment C) illustrates the land area subject to the vACAT1oN request. 6.O PUBLIC HEARING AND PLANNING COMMISSION RECOMMENDATION _ 6.1 On June 3, 2009 the Roseville Planning Commission held the duly-noticed public hearing � regarding Mr. Plumb's request for right-of-way vACAT1oN. No one in the audience � addressed the Planning Commission during the public hearing and no communication � from the public on this matter has been received by staff. Draft minutes of the Planning � Commission meeting are included with this report as Attachment D. � 6.2 Pursuant to the public hearing, and based on the comments and findings outlined in � Section 5 of this report, the Planning Division and Public Works Department concur with � the Planning Commission recommendation to approve the proposed right-of-way 4 VACATION. 4 7.O SUGGESTED CITY COUNCIL ACTION � Adopt a resolution approving the requested right-of-way vacaTioN, based on the comments of Section 5 and recommendation of Section 6 of this report; a draft resolution is included as Attachment E.
