4.O BACKGROUND <br />� 4.1 Mr. Plumb owns the property addressed as 501 South McCarrons Soulevard, located at <br />� the intersection of Roselawn Avenue with North and South McCarrons Soulevards. Mr. <br />� Plumb's property has a Comprehensive Plan designation of Low-Density Residential <br />� (LR) and a zoning classification of Single-Family Residence District (R-1). <br />4.2 This request stems from Mr. Plumb's plans to make some modifications to his home. <br />5.O STAFF COMMENTS <br />� 5.1 The subject land area appears to have been included in a Supervisor's Road Order, dated <br />� May 19, 1887, creating a public highway. Although neither Ramsey County nor the City <br />� of Roseville currently identifies the subject land area as public right-of-way (xow), the <br />� City's records contain no indication that this portion of the "public highway" was ever <br />� formally vacated; this is why the City is now being asked to consider vACATiNG any <br />� interest in this property. <br />_ 5.2 When reviewing requests for vacating a public xow, the Public Works/Engineering <br />_ Department determines whether the request will, immediately or in the future, have an <br />_ adverse impact the general health, welfare, or safety of the citizens of the City of <br />_ Roseville. The Public Works Director has reviewed and approved the survey and legal <br />_ description of the land area to be vacated and has determined that the interests of the <br />_ public will not be compromised by vACATiNG this portion of South McCarrons <br />� Soulevard xow. The site plan included with this staff report (Attachment C) illustrates <br />the land area subject to the vACAT1oN request. <br />6.O PUBLIC HEARING AND PLANNING COMMISSION RECOMMENDATION <br />_ 6.1 On June 3, 2009 the Roseville Planning Commission held the duly-noticed public hearing <br />� regarding Mr. Plumb's request for right-of-way vACAT1oN. No one in the audience <br />� addressed the Planning Commission during the public hearing and no communication <br />� from the public on this matter has been received by staff.
