S.P. 6241-51 (T.H. 280) <br />Mn/DOT Agreement Number 92042 <br />Ramsey County <br />2) Pursuant to Minnesota Statutes, section 115.07, and Minnesota Rules, part <br />7001.1030, the City must submit the plans and specifications for sanitary sewer <br />construction or reconstruction to the Minnesota Pollution Control Agency <br />(MPCA). The City must obtain the necessary permit or waiver from the MPCA <br />before performing the construction or reconstruction. Minnesota Rules, part <br />7001.1040 requires the City to submit a written application for the permit or <br />waiver at least 180 days before the date planned for commencing the sanitary <br />sewer facility construction or reconstruction. <br />III. City's Ongoing Maintenance Requirements <br />A) Once construction is complete, the City must maintain the Facilities at its own <br />expense. The City must follow the terms of the permit when it performs any <br />maintenance work. <br />B) The City may open and disturb the trunk highway right of way without a permit in the <br />case of an emergency that is dangerous to the public and requires immediate <br />attention. Upon learning of an emergency, the City must immediately notify the State <br />Patrol. The City must take all necessary and reasonable safety measures to protect <br />the public and must cooperate fully with the State Patrol. In this event, the City must <br />request a permit from the proper authority no later than the working day after it begins <br />working in the right of way. <br />IV. Property Rights <br />A) The City must convey, by Quitclaim Deed, its right, title, and interest in property <br />located in Ramsey County, Minnesota to the State. This property is legally described <br />as: <br />That Part of the City's Easement No. 1533923 over, under and across the Northwest <br />Quarter of the Northwest Quarter of Section 17, Township 29 North, Range 23 West <br />which lies westerly of the east right of way of T.H. 280 and will be described further in <br />the Quitclaim Deed. <br />V.
