Malinen, City Manager <br />2660 Civic Cenier Drive <br />Roseville, Minnesota 55113 <br />Re: I 947 Co�inty Road C W- Fornier Indianh.ead Trucking Property <br />Offer of Just Compensation - Parcel 8 <br />Twin Lakes Infrastruciure Improve�nents - Phase I. <br />WSB Project #1814-00 <br />Dr. Mr. Malinen: <br />This letter will canfirm that on April 22, 2009, Roseville Acquisitions, LLC received from the City of <br />Roseville a letter dated Apri] 8, 2009 fo�ether with a1� Offer to Purchase a portion ofthe property located at <br />] 947 Co�nty Road C W(�'ormer Indian.head T3-ucking Property) (the "Property"), a copy of an appraisal <br />performed by DahIen, Dwyer and Foley, Inc., a three page handout titled "Acquisition Inforrnation fnr <br />Pi•operty Owners," Acquisition and Appraisal Summary showing a value of $1,OS1,SOd and a parcel <br />skete��. We are pieased to accept your offer referenced in the April S, 2009 letter, subject to the foIlowing <br />clarifications and/or modifcations: <br />Demolition. The City of Roseville agrees to pay all casts necessary to comp]etely demolish and <br />remave the building located within the portion oi the Properiy to be conveyed to the City {the <br />"Future Rig}�t of Way") on or before Ju�le l, 2009. <br />Mount Rid�e Road. The City of Roseville agrees al its sole cost and expense to €ake all necessary <br />action (including, �rithaut kimitation, vacation proceedings, written conveyance, iermination of <br />rights) to, on ar before June 1, 2009, vacate the partion of Mount Ridge Raad and any easen�ents <br />focated therein which abut t�ie Property and (ii) cause ownership af one-l�aif of such road to be <br />vested in fee simple in the name of the adjacent property ow�ners ]ocated to the east and west af the <br />road. Fee simple ownership in Mount Ridge Road will be transferred to the adjacer�t property <br />awners without any requirement of payrz�ent ta the City of Roseville. <br />3. Pond. The City of Roseville agrees to grant a�ld convey to the owner af the Property a perpetual <br />easement %r drainage of stonn water from the portion of the Praperiy that is designated to drain to <br />Langton Lake into any retention pond or ponds constructed on the praperty located to the east of <br />the Property by or at the direction of the City of Roseville.
