Attachment J <br />CITY of ROSEVILLE <br />PLANNED UNIT DEVELOPMENT AGREEMENT #1375 <br />APPROVED SEPTEMBER 15, 2008 <br />REVISED AUGUST 24, 2009 (PF07-006) <br />This PLANNED LJNIT DEVELOPMENT AGREEMENT ("AGREEMENT"), dated September <br />15, 2008 is entered into between the City of Roseville, a Minnesota municipal corporation, of <br />2660 Civic Center Drive, Roseville, Minnesota 55113 (herein referred to as "CITY") and United <br />Properties, 3500 American Boulevard West, Suite 200, Bloomington, MN 55431 (herein referred <br />to as "DEVELOPER"). <br />An amendment to this AGREEMENT at the request of the DEVELOPER was approved by <br />the Roseville City Council on August 17, 2009, and is continued between the CITY and the <br />DEVELOPER. <br />1. Effective Date of AGREEMENT <br />This AGREEMENT shall be effective upon completion of the following: 1) Passage of <br />Applewood Pointe of Langton Lake, the required subdivision plat for the property, and <br />submission of the same for recording with the Ramsey County Recorder; 2) Passage and <br />publication of Ordinance #1375 rezoning the property from Single Family Residence (R-1) <br />District to Planned Unit Development (PUD) with an underlying zoning of General Residence <br />(R-3) District; 3) submission of all revised plans identified as Exhibits in Section 4 of this <br />AGREEMENT; 4) execution of this AGREEMENT by the CITY and the DEVELOPER; and <br />4}5) submission of this AGREEMENT for recording with the Ramsey County Recorder. <br />2. Request for Planned Unit Development Approval <br />The DEVELOPER has requested that the CITY approve an 6.5 acre redevelopment consistent <br />with the Roseville Comprehensive Land Use Plan and the Twin Lakes Master Plan into a <br />Planned Unit Development (PUD) *'��* �r�'���'°°of a 4-story, °�age-restricted senior <br />cooperative of up to 95 residential units developed in two phases: Phase I comprising <br />approximately half of the 95 units, and a possible Phase II with a maximum full build-out <br />of the remainder of the approved 95 units. <br />Upon recording of the plat, the �Subject Property is legally described as: <br />Lot 1 and Lot 2, Block 1, n°,*'^* ^^,,,,a n°,*'^* R Applewood Pointe of Langton Lake <br />3. Planned Unit Development Approval <br />The CITY hereby grants approval of the amended Planned Unit Development (identified as <br />Exhibits A through I in Section 4.0 of this AGREEMENT), subj ect to the DEVELOPER' S <br />compliance with the terms and conditions of this AGREEMENT and any and all applicable <br />requirements of Title 10 of the Roseville City Code, unless otherwise identified herein. The <br />CITY agrees to approve applications for building permits, if said applications meet all of the <br />requirements for issuance of building permits and are consistent with the plans identified in <br />Section 4.0 below. <br />Page 1 of 10 <br />
