REQUEST FOR COUNCIL ACTION <br />Department Approval: Manager Reviewed: <br />�� � �� <br />Description: Statutory Limits <br />Background <br />DATE: 02/12/07 <br />Item Number: S.c <br />Agenda Section: <br />Consent Agenda <br />Minnesota Statute 466.04 states that liability of any municipality on any one claimant shall not <br />exceed $300,000 when the claim is for death, wrongful act, or omission and shall not pay more <br />that $1,000,000 for claims arising out of a single occurrence. <br />A city has the opportunity to waive the individual statutory limit. By waiving the statutory limit, <br />there is no limit on the settlement a claiznar�i(s) may receive. <br />Financial Implications <br />Waiving the statutory limit will increase the policy premium and increase the amount of <br />settlement a clairrzant(s) may receive. <br />Staff Recommendations <br />Staff is recommending that the City Council does not waive the monetary limits on municipal <br />tort liability establishedby Minnesota Statute 466.04. <br />Council Action <br />Motion to approve not waivin� the monetary limits on municipal tort liability established by <br />Minnesota Statutes 466.04. <br />
