Roseville City Council <br />DRAFT Minutes of 1 rf �9� �'� Pg 15 of 38 <br />� 8. �onside�/A��ess the Presumptive Penalty for Axel's Charhouse Sale of <br />:� Alcohol to a Minor <br />� City Attorney Scott Anderson reviewed the December 4, 2006 violation by <br />� two employees of Axel's Charhouse selling alcoholic beverages to a minor <br />� in violation of City ordinance; and their lack of participation in the optional <br />� manager and server training program provided by the City of Roseville's Po- <br />� lice Department. <br />� <br />1[� Mr. Anderson provided the process for a violation, with the Police Depart- <br />1 1 ment providing information to the City Council, which assesses presumptive <br />1? penalties as set forth or departure upward or downward based on extenuating <br />1 � or aggravating circumstances. <br />1� <br />1� Mr. Raymond Luczak, current General Manager at AYeI's Charhouse, <br />1� 2540 Cleveland Avenue, Roseville <br />1',� Mr. Luczak provided documentation for the record, which was reviewed by <br />1� Mayor Klausing and Councilmembers, and consisted of a Certificate of <br />1{� Compliance from the City of Roseville for the years 2002,2003 and 2004; <br />�r� and a certificate showing Axel's Char House as a member in good standing <br />�] of the Minnesota Licensed Beverage Association for 200612007. <br />�� <br />�� Mr. Luczak opined that the non compliance event was due to a lack of com- <br />�� munication between the General Manager and Bartender, during a busy time <br />�� in the bar, and was not due to a lack of training; noted the company's previ- <br />�� ous compliance and participation in a training program; and respectfully re- <br />�� quested a reduction in the proscribedpenalty. Mr. Luczak advised that the <br />�� company was accepting full responsibility for their actions and that in ac- <br />�� cepting that responsibility, they were willing to abide by the decision of the <br />�� City Council. <br />�1 <br />�� Discussion included penalty based on the number of violations; voluntary <br />�3 participation in training programs over the last 36 months related to the <br />�� amount of suspension time; the company's training program in conjunction <br />;�� with their downtown Ramada location through the Minnesota Beverage As- <br />��� sociation and combined training for both locations; and their lack of partici- <br />�� pation in the Roseville training program. <br />�� <br />�� Roseville Police Chief Carol Sletner advised that the establishment didn't <br />�+t� submit their training program to the Police Department for their review and <br />
