<br />S. p. 6216-27 (T. H. 51-125) Ramsey County, State of Minnesota,
<br />Village of Roseville
<br />WHEREAS, the CoDU11issioner of Highways of the State of Minnesota has
<br />now determined to designate and make permanent the location of Trunk Highway
<br />No. 51 formerly designated as Trunk Highway No. 125, through the Village
<br />of lioseville as shown upon the plans which are presented herewith and made
<br />a part hereof, and
<br />WHEREAS, said Commissioner of Highways is desirious of oonstructing,
<br />reconstru ction and improving said Trund Highways through said Village and
<br />prepared plans for said construction, reconstruction and improvement, a
<br />copy of which said plans are- presented herewith and made a part of this
<br />resolution, and
<br />WHEREAS, the oonstruction, reconstruction and improvement of said
<br />Trunk Highway requires a change in the grade of the streets in said Village
<br />along and upon whL~h said Trunk Highway passes, said Change of grade being
<br />designated and shown on said plans, and
<br />\~lliREAS, it is to t~e best interest of the Village that said Trunk
<br />Highway be constructed, reconstructed, and improved through said Village
<br />in accrdance with said pkans and the standard Minnsot~ Highway Specifications
<br />and upon the grade designated therein, and
<br />WHEREAS, the Commissioner of Highways is dewirious that the Village
<br />of Roseville, will not license or permit hereafter, any encroachment ...,f
<br />any nature, including curb gas pumps or gas stations O~ billboards of
<br />Clther structures of any kind whatsoever, on the ri8ht of way of said Trunk
<br />Highway No. 51 within the corporate limits of said Village of Hoseville
<br />as shown upon the plans and maps hereto attached, and
<br />WHEREAS, in the furtherance of the Public well being and safety it
<br />is desirable and necessary to eliminate traffic hazards by eliminating any
<br />encroachements whatsoever, now or hereafter existing in or upon the said
<br />Trunk Highway right of way, and
<br />WHEREAS, said Commissioner of Highways desires" in the interest of
<br />Public Safety, that all parking of vehicles on said Trunk Highway be parallel
<br />with the curb and at least 20 feet from any crosswalk at all Public streets
<br />intersecting said Trunk Highway within the corporate limits of said
<br />Vi llage, and
<br />WHEREAS, it is to the best interests of said Village that all parking
<br />of vehicles be parallel to the curb;
<br />NOW, TH.[!;REFDRE, BE IT RESOLVED, that said plans and spe'ifications
<br />for the construction, reconstruction and improvelllBat of said Trunk Highway
<br />through said Village, be and the same along which said Trunk Highway
<br />passes, as shown in said plans; and
<br />BE IT FURTHER RESOLVED, that said Village does hereby agree and convenant
<br />that it will never permit or suffer, within its corporate limits, an,.
<br />encroachment of any kind whatsoever including curb gas pumps and gas stations,
<br />billboards or other structures of any kind whatsoc'ler, upon the right of
<br />way of Trunk Highw~y 51 as shown on said plans and that to the above end
<br />said Village hereby agrees that it will never issue any license, permit,
<br />or grant or give any leave or liberty or any other consent of whatever"
<br />for.m for the construction or maintenance of any encroachement whatsoever
<br />including curb gas pumps, and gas stations, . illboards or other structures
<br />of any kind whatsoever, upon said right-of-way; and that sid constituting
