Regular City Council Meeting
Monday, March 26,2007 - DRAFT
Page 26
cord, and that neighborhood opposition alone was not upheld by the courts
as rationale for City Council denial.

Mr. Reiling expressed astonishment that the daycar was not concerned on
behalf of the children and their exposure to additional vehicle emissions.
Mr. Reiling opined that the City Council had a special obligation to take care
of people in the community and watch out for their welfare.

 c
1]
l
t
t
1
1
1'

39

1

4

'
Councilmember Pust clarified that she was not seeking an argument, but
noted her reliance on all considerations, citizen concerns, and balancing a11
interests for the overall, long-term benefit of the City. Councilmember Pust
read the letter verbatim, so as not to paraphrase the intent. Councilmember
Pust opined that she needed to consider all evidence in record, and sought to
clarify the daycare director's response so that it was accurately stated in the
record.
Councilmember Pust further addressed her definition of "contiguous proper-
ties," as noted by Councilmember Ihlan, and opined that, while properties
across the street would no-doubt be impacted, they could not be considered
as contiguous properties. Councilmember Pust observed that, with regard to
the hours of operation of the drive-thru, the traffic generated by the daycare
was already impacting the neighborhood during early morning hours. Coun-
cilmember Pust commended Mr. Reiling on his research; however, noted
that his projections and findings were consistent with those provided by the
RLK traffic study; and concurred with Councilmember Roe's observations
that traffic is an issue already, whether or not the drive-thru is approved.
Mr. Reiling strongly disagreed with Councilmember Roe and Mayor aus-
ing, and alleged that they were trivializing the situation. Mr. Reiling refer-
enced the recent agreement the Mayor signed supporting reductions in
: t global warming and local efforts to seek reductions; and opined that the
Mayor should abide by the agreement he had signed.

7

S]
Mayor Klausing allowed Ms. Reiling to read a statement summarizing a
study done by the University of Southern California and their findings of
significant lung impairment to a study group of 3,600 children during a 13
year study; and purported impacts of living in communities with exposure to
freeways.
