The Pub�ic Works, En�ironrnent, and Transportaiion Commission began studying <br />the present Fertiiizer Ordinar�ce far �ossible updating in rr�i� 2006. Members feit ac�ditional <br />lang�age s�auld be added regardin� the use of pest:icides in the City, and the public should be <br />�otified as to w�ere pesticides have been app�ied. <br />TI�e City Attorney of�'ez�ed t�at the City is li�nited by State Sfiatute as to what cary be regulated. <br />State Statute oz�ly allaws cities to regulate signage. Wi�h this inforrnaiion, the Cazn�r�ission asked <br />that la.z�guage be �rafted ta madi�y t�Ze �ertilizer ordinance to regulate and require warning <br />signage �'or cornmerciai an.d certain non-commereial applzcators. The Commission also <br />sup�orted updating other areas nf �ie fertilizer ord��nance. Tl�e ardinance name shou�d inclu�e <br />pesticides, and the ordinance is o�t o�date with current stat�te lirniting t�e use of pho��ahnrus in <br />fertzlizer content. <br />The Cozannaiss�oz� also recomrriends iz�creasing the huffer from r�ater resouurces �rom the current <br />1 Q£eet to 50 i'eet, wl�ich is amore cansistent with watershed districi ma.�ageme��� plaris. Attac��d <br />are ihe prnpos�d az�ending ordinanee and �he fizza� ardinance. <br />T�e �'WETC al�o is recommending staff wark on ar� educational effart to familiarize the <br />community of thes� cha�ges, as weli as t�e benefits of protecting our water �esaurces. Staff will <br />be warking with the Waters�ed Districts and the Soil and Water Gons�rvation District i� an <br />effort to educate residenfs ox l�ow they can he�p a�d what tools and reso�rces are available to <br />�hem. <br />Fivaneial Implica��ons: There is minimal cost to implemezati�g th�s ordinance change and <br />educaiional effort.
