City Council Regular Meeting —12/19/OS <br />DRAFT Minutes - Page 20 <br />Maschka moved, Ihlan seconded, scheduling a Public <br />Hearing for January 9, 2006 for consideration of revisions <br />to the 2006 Resolution related to fees. <br />Roll Call <br />Ayes: Kough; Maschka; Ihlan and Klausing. <br />Nays: None. <br />Abstentions: Schroeder. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 7:55 p.m. <br />and reconvened at 8:07 p.m. <br />8. Update about Property Acquisition at Twin Lakes; Consider <br />Eminent Domain Resolution <br />Attorney Rod Krass of the firm Krass Monroe, provided a <br />historical review of previous meetings related to property <br />acquisition by Roseville Twin Lakes, LLC (the redeveloper) and <br />real estate representatives and possible use of eminent domain. <br />Mr. Krass advised that the redeveloper and real estate consultants <br />had made additional offers, in accordance with City Council <br />instruction, on four remaining parcels. Mr. Krass noted the need <br />fro prudence in not disclosing amounts in a public setting, the <br />aggregate offers made by the redeveloper were 97% of the <br />aggregate values determined by the City's own appraisers; and <br />that despite those significant advances, the remaining four <br />parcels remained unacquired. <br />Mr. Krass advised that the parties were in similar agreement <br />related to property values, but the amount determined to be <br />escrowed for potential contamination appeared to be the <br />problem. <br />Mr. Krass noted that six properties were included as attachments <br />to the resolution, the four previously identified, in addition to <br />two additional properties; one as per the request of the property <br />owner for IRS purposes, and one due to a tenant not wishing to <br />relocate. <br />Mr. Krass noted that all properties were owned by sophisticated <br />Resolution 10367 <br />Update about <br />Property <br />Acquisition at Twin <br />Lakes; Consider <br />Eminent Domain <br />Resolution <br />
