City Council Regular Meeting —12/19/OS <br />DRAFT Minutes - Page 2 <br />Mr. Anderson addressed the proposed adoption of the <br />International Property Maintenance Code (IPMC) as part of <br />the Roseville City Code. Mr. Anderson expressed concern <br />regarding criminal action against property owners for lack <br />of compliance; opining that in some instances, property <br />owners may not be physically able to take care of the <br />property and should not be penalized. <br />Mr. Anderson also questioned whether the City had the <br />legal authority to block property sales when homes didn't <br />meet City Code; noting that some prospective buyers <br />purchased inferior properties to repair and resell; and that <br />such a clause could institute interference with interstate <br />commerce. <br />Economic Development Specialist and Housing and <br />Redevelopment Director Cathy Bennett responded to Mr. <br />Anderson's concerns by noting that particular provision in <br />the ordinance was not being proposed. <br />City Attorney Jay Squires noted that various truth in <br />housing programs in some metropolitan communities <br />required an inspection and certification by the City as part <br />of the closing documents. <br />Councilmember Ihlan referenced Section 741.05 of the <br />proposed code; and shared Mr. Anderson's concerns. <br />Ms. Bennett noted that the proposed code was addressing <br />ongoing issues with a specific property in an effort to <br />ensure compliance; but was not addressing overall <br />properties. <br />B. John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn referenced a recent article in the Pioneer <br />Press, dated Saturday, December 17, 2005 regarding <br />quotes from Mayor Klausing on the use of City reserves. <br />Mr. Kysylyczyn disputed the interpretation and use of <br />reserves; previous comments from the State Auditor <br />regarding comparison reserves; and comments regarding <br />changes to the budget at this time and following the <br />
