Departnlent Approval <br />DPW <br />REQUEST FOR COUNCIL DIRECTION <br />City Manager <br />DATE: 02/13/06 <br />ITEM NO: 9. <br />A�enda Section: <br />It�m D�scriptio��: Amendmeni to text of Ci�y Code Title 4, Section 407.02, Subsection <br />407.02G speci�icall�� �'e[ating to #he raisang and keeping of poultry and <br />bees within the Cit of Roseville PF 3557 <br />1.0 BACKGROUND; <br />1.1 The City of Roseville City Code is a co�nplatian af ordina�lces, many of whicll date back ta the <br />early 195ds. At that tizne the City had numerous small far�ns in the co�nmunity. Some raised �igs, <br />�oultiy, and other Iivestocl�, while others raised flowei's and vegetables. The density of residei�ts <br />was 20% of t�e current develo�ment �attern. The nat�iral envirannzent cauld absorb the nutrients, <br />noises, and n�isances narmalIy associafed with agricuthiral p�-od�ctic�n. Today there are no <br />agricultural zanes remaining in th� conlnzuniry. <br />1.Z T�e City Code �Section 407.02 attempts to identify nuisances affecting k�ealth, safety, camfart or <br />re}�ose. Subsection 407.02G states that the keeping of fann animafs is a n�isance. However, it does <br />specifical�y exempt paultry (such as chicken, ducks, turkeys, etc) and it does r►ot mention bees. if <br />not considered a f'ann animal, are these animals to be considered "pets" ar"exotic petslaniliiats" <br />under t�ae Code. Clarity is needed. As an exa�z�ple, as in the case of a barking dog coinplaint, are <br />palice �a chase dowt� a wondering ar crowing c�icken? Is the Hu�zlane Society ta be cai�ed far <br />such animals? <br />1.3 Tn 2005 City Code staff received a number of coinp�ainis about pault�y, especially chick�ns and <br />roostea-s. Coinplaints are varaed: fear of tl�e birds, th� �arly morning crowing, general noise and <br />smell, how many can be kept on a site?, what z►�ust a z�eighbor do about trespassing animals, Asian <br />Bird Fiu caz�-iers, and the aninlal waste runoff. in addition, staff has concerns t11at birds tnay be <br />raised for fi�hting (othez- suburban comrntrnities have experienced this cock fighting pheno�nena). <br />1.4 Regardin� bees, the purposeful raisiiZg and ]ceeping of bees for the production of honey creates a <br />serious �zealth concern far residents (es�ecially the young and elderly) with adverse reactions to <br />hee stings. The Ciry Code currently states that such agricult�re activities cannot occur within 300 <br />feet of any residential lot.
