City Council Regular Meeting — 02/27/06 <br />DRAFT Minutes - Page 19 <br />Additional discussion included lot line dimensions; the easement <br />on Parcel C to accommodate the driveway on Parcel B; <br />topography and balance of land use and general guidelines for an <br />open space environment from a planning standpoint; and <br />property owner rights and consistency with law provisions. <br />Councilmember Ihlan reiterated her interpretations of and <br />objections to this request; as well as her preference for a <br />moratorium. <br />Further discussion included lot depth and width definitions; lot <br />depth as a function of design; and definition of "depth" and <br />"width" <br />Councilmember Maschka questioned, if the house was not there; <br />the three lots of approximately 17,000 square feet each, would be <br />similar to other lots in the neighborhood; and that the easement <br />for the driveway was to make the one lot legal; and questioned <br />whether, given that scenario, it was a legal basis for denial. <br />City Attorney Anderson opined that, legally, he didn't see <br />anything in City Ordinance regarding Minor Subdivisions that <br />said a lot had to be a regular shape, or that an applicant couldn't <br />do what was proposed with the driveway and easement. <br />[7.1� <br />Klausing moved, Pust seconded, approval of a minor subdivision <br />for Jon Forman, Planning File 3699, a three Parcel Minor <br />Subdivision as per City Code, Section � X 04,04E creating three <br />new parcels A, B and C(Parcel "B" to have the existing house) <br />with a parcel size of at least 15,000 square feet, based on the <br />findings in Section 5 and subject to the conditions of Section 6 of <br />the project report dated February 27,2006. <br />Councilmember Ihlan, speaking in opposition to the motion, <br />noted the original petition signed by 27 neighbors, expressing <br />their disapproval for the request of a 15 foot variance for the <br />property; opining that a variance was still needed and that the <br />current and modified request didn't meet code requirements. <br />
