Councilmember Ihlan reiterated her interpretations of and objections to this request; as well as her preference for a moratorium. Further discussion included lot depth and width definitions; lot depth as a function of design; and definition of "depth" and "width" Councilmember Maschka questioned, if the house was not there; the three lots of approximately 17,000 square feet each, would be similar to other lots in the neighborhood; and that the easement for the driveway was to make the one lot legal; and questioned whether, given that scenario, it was a legal basis for denial. City Attorney Anderson opined that, legally, he didn't see anything in City Ordinance regarding Minor Subdivisions that said a lot had to be a regular shape, or that an applicant couldn't do what was proposed with the driveway and easement. [7.1� Klausing moved, Pust seconded, approval of a minor subdivision for Jon Forman, Planning File 3699, a three Parcel Minor Subdivision as per City Code, Section � X 04,04E creating three new parcels A, B and C(Parcel "B" to have the existing house) with a parcel size of at least 15,000 square feet, based on the findings in Section 5 and subject to the conditions of Section 6 of the project report dated February 27,2006. Councilmember Ihlan, speaking in opposition to the motion, noted the original petition signed by 27 neighbors, expressing their disapproval for the request of a 15 foot variance for the property; opining that a variance was still needed and that the current and modified request didn't meet code requirements.
