of City Councilinembers or the City Manager should go to the City Attorney for investi- <br />gation, while ethics complaints about city staff other t��a�� the City Manager should go to <br />the Manager. That is the process we have followed. <br />RECOMMENDATION <br />For the reasons that follow, I recommend that the Council rescind Resolution 8593, and <br />adopt an Ordinance creating ethics guidelines and creating a three-member Ethics Com- <br />mission. <br />I have not drafted such an Ordinance yet. But here are the features I envision: <br />• Ethics guidelines similar to those in the former Resolution; <br />• Periodic, mandatory ethics training for all city employees and city officials; <br />. A three-member Ethics Cot�inissian to sponsor ethics training azad to give advice <br />about the application of the ethics guidelines. <br />. Ethics complaints would still be filed with the City Attorney as they are now for <br />investigation, and the City Attorney is free to seek input from the Ethics Commis- <br />sion to assist his investigation and report. <br />I recommend abolishing the Resolution because (a) in effect, the Resolution has already <br />been substantially modified, if not rescinded, by the subsequent 3-2 Council motion abol- <br />ishing the Commission, and (b) an Ordinance is a more visible and more permanent way <br />to create a citizens' advisory commission. <br />I believe a citizen co���nassioi� is the best way to assure that ethics issues are taken seri- <br />ously. The Ethics Coin�nission can develop and advance a training curriculum for city <br />employees and officials. On the other hand, I believe the City Attorney is better prepared <br />to investigate specific ethics complaints. Attorneys are already trained in investigating <br />complaints, finding out what the facts are, and applying specified standards of conduct to <br />a set of facts. If the City Atton�ey wants or needs input by the Coznmission, the City At- <br />torney can certainly ask and I'm sure the Commission would assist. <br />REQUESTED ACTION <br />If the Council agrees that Roseville should have an Ethics Cammission and �l�at there <br />should be an ordinance creating tl�is Commission, I will work with the City Attorney to <br />create such an ordinance. With Council's approval, I envision presenting a draft ordi- <br />nance for Council discussion within a month. <br />.� <br />
