Execurive Director Bennett summarized the issues and addressed many of the quesrions. She <br />explained the appeals process that requires council final approval. She noted that the intent of the <br />ordinance is to work with property owners and that if they are making efforts to evict a problem <br />tenant that they would not be penalized. This language has been added to the draft ordinance. <br />SEIe noted that there has been extensive research by the staff and HRA on this issue. There was <br />comparison o�surrounding sister community's programs, ordinances, fees and issues. The draft <br />ordinance was prepared with the guidance of the City attorney and that each secrion came from <br />other city ordinances. Ms. Bennett noted that the ordinance includes providing the tenants with a <br />handbook of tE�e city codes and what is expected of them of which the tenant's rights can also be <br />provided as requested by the Human Rights Commission. Ms. Bennett noted that professional <br />standards for any inspector that would be hired to implement the program would be required. Ms. <br />Bennett read the League of Women Voters quesrions and tried to address each but noted that they <br />would be posted on the web as well. Mr. Munson addressed the overcrowding and parking <br />issues and menrioned that existing codes can not affecrively address this currently. Also, even if <br />the property maintenance code is adopted, verificarion of overcrowding is difficult without <br />interior access to verify beds, etc. The rental ordinance would provide access to verify <br />occupancy. <br />Chair Majerus asked if the current codes are adequate to address the issues? (No) <br />Member Kelsey asked if mailed cards were sent to non-homestead property owners only? (Yes, <br />over 500 cards mailed). <br />Execurive Director Bennett suggested that the I�RA ask the Council for more rime to review the <br />issues brought forward tonight and come back in February with more discussion and a <br />recommendation. <br />Motion: Member Majerus moved, seconded by Millasavich to defer action and recommend <br />extending study and review of ordinance until February 21,2006 meeting. <br />Ayes: 6 <br />Nays: 6 <br />Motion carried <br />
