City � Shoreview Municipal Code Chapter 2pp. Development Regulations <br />(5) All fill and grading activity shall comply with all other standards of the <br />City's Development Ordinance. <br />(6) Prior to issuance of a building permit for new home construction, an <br />"Erosion Control Requirements of Building Permit" form shall be <br />executed. <br />(7) All fill and grading activity shall comply with the performance standards <br />set forth in Minnesota Statutes 307.08. Private Cemeteries Act. <br />(G) Shoreland Mana e� ment• In addition to the regulations stated in this Section, <br />development activities on riparian lots having frontage on Minnesota <br />Department of Natural Resources (DNR) classified protected waters are <br />subject to the provisions of 209.080(G) (Shoreland Management). <br />209.050 Veeetation & Woodlands. <br />(A) Preservation. Vegetation shall be left intact to the maximum extent possible <br />to retard surface run-off and soil erosion, to utilize excess nutrients, and to <br />conserve nutrients in the soil and to preserve shoreland aesthetics. <br />(B) RemovaL The removal of vegetation shall he controlled in accordance with <br />the following criteria: <br />(1) All Properties. <br />(a) Vegetation shall be restored during and after all construction projects <br />that require a building permit to retard surface runoff and soil erosion <br />in accordance with Section 2�9.040(D), Soil Stabilization. <br />(b) Development shall be conducted so that the maximum number of <br />trees, in particular landmark trees, are preserved by the clustering of <br />structures in existing cleared areas and natural clearings, and the <br />utilization of other site design techniques. Design of the site and <br />construction activities shall he conducted in a manner to avoid likely <br />injury to Landmark Trees. <br />(c) The developer shall remove seriously damaged, diseased or dead trees. <br />(2) New Development. All private-sector development proposals that involve <br />the construction of a public street or private road and for all new non- <br />single dwelling development�: <br />(a) The Tree Preservation Plan. A tree preservation plan shall be <br />submitted. This plan shall identify the trees to be preserved on the site <br />and the methods to be employed to insure that the identified trees are <br />Section 209. Envirornnental Standards 209-9 <br />
