City � Shoreview Murricipal Code Chapter 200. Development Regulations <br />(i) Landmark Trees Not Located Within a Shore or Bluff Impact <br />Zone. Landmark trees shall not be removed unless authorized by <br />the City. Such authorization shall not be granted unless: <br />(aa) A finding is made that the presence of the tree(s} unreasonably <br />inhibits practical use of a property, the tree(s} is diseased, or it <br />presents a public safety hazard. <br />(bb) A responsible party (property owner, developer, or city in the <br />� case of a public improvement, etc.) agrees to replace each <br />_ healthy landmark tree removed with trees of a species and <br />_ location acceptable to the City at the ratio below. The size of <br />_ the new trees shall comply with the standards set forth in <br />Section 20b.010(J} for new construction. ff space is not <br />available on the development site, the replacement trees shall <br />he planted elsewhere in the community, as is acceptable to the <br />City Council. <br />Lot Area <br />Less than 20,000 sf <br />20,001 to 40,000 sf <br />40,001 and more <br />Replacement Trees <br />(replacementJla..n .d...tnark� <br />1:1 <br />2:1 <br />3:1 <br />(ii) Landmark Trees Located Within a Shore or Bluff Impact Zone <br />See Section �C�}.�75C+113'����E_ <br />(aa) Exis�in� Sin�le Family Residential. Lots on which a single <br />family residential home was constructed prior to the effective <br />date of this ordinance are not subject to the replacement <br />requirements for landmark trees unless development as <br />defined in Section �fµJ.[]?[i[E3r��� i{a j is occurring. <br />(4) Shoreland Mana eg ment. In addition to the regulations stated in this <br />Section, development activities on riparian lots having frontage on <br />Minnesota Department of Natural Resources (DNR) classified protected <br />waters are subject to the provisions of 209.080(h} (Shoreland <br />Management). <br />(5)Fublic I�nprovement Proiects. For public street reconstruction and other <br />public improvement projects, the following tree replacement standards <br />shall apply: <br />(a) A minimum of one-for-one replacement for any tree in excess of 4 <br />inches of diameter that is to he removed as a result of the construction <br />activity. <br />Section 209.
