��F� � <br />�,�_:.�,�- - � � ----� � � <br />Monday, December 23, 2002 <br />Mr. Pisanu Sukhtipyaroge, Owner <br />Royal Orchid Restaurant <br />2401 Faixview Avenue North <br />Roseville, Minnesota 5 5113 <br />Dear Mr. Sukhtipyaroge: <br />On December 6, 2002, Mr. Thauh Van Ha served an alcoholic beverage to <br />an underage person at your restaurant. Under the Roseville City Code <br />the penalty for a first offense at serving liquor to an under-aged person is <br />a$500 fine and a one-day suspension of one's privilege of serving liquor. <br />The Chief of Police set the suspension date as Friday, December 27. Mr. <br />Sukhtipyaroge has appealed to me. A hearing was held in Roseville City <br />Hall this date involving Royal Orchid Owner Mr. Pisanu Sukhtipyaroge, <br />Police Chief Carol Sletner, and City Manager Neal Beets. <br />Mr. Sukhtipyaroge had six reasons for appealing, which he described at <br />the hearing: <br />l. Liquor sales are a very small part of his business, about ���°:•'�, and <br />liquor is only provided for customer convenience. <br />2. Mr. Sukhtipyaroge passed his two previous liquor compliance <br />checks in Roseville. <br />3. Mr. Sukhtipyaroge had no liquor compliance problems in <br />Minneapolis the previous 13 years before opei-�ing in Roseville <br />4. The Royal Orchid is a family restaurant. Mr. Sukhtipyaroge's sons <br />usually wait tables, along with his sister-in-law. According to Mr. <br />Sukhtipyaroge, they know to check the identification of young <br />looking customers. The waiter that night was there only because <br />Mr. Sukhtipyaroge's sons took part of the weekend off and Mr. <br />Sukhtipyaroge was in a jam. Mr. Sukhtipyaroge thought this <br />waiter had experience and knew to check identification. Moreover, <br />Mr. Sukhtipyaroge believes this server may have diabetes and his <br />attention may wander. <br />5. The $500 penalty is too harsh. Mr. Sukhtipyaroge says he grosses <br />about $1,000 on weekend nights.
