I would lilce <br />to focus first on the council's power and responsibility to impose the mandatory �t�Enimutn penalties under the ordinance. I <br />propose that the council should hold a public hearing and consider whether there is any basis for deviating fro�n the penalties <br />required under 302.15. i would appreciate any advice the city attorney has on how to do this. <br />I would also lilce to request legal analysis on whether the city council is required to hold a public hearing to temporarily <br />suspend a liquor license, or whether it would be possible to simply impose the mandatory minimum penalties in the <br />ordinance without any cota�lci[ involvement, with any appeals going to court. <br />I believe all of these are public policy issues that must be discussed at an open public meeting. He says that the Maple Grove city <br />attorney has decided not to move forward with the complaint, and that it is now appropriate for the council to talce up these <br />issues again. Since Jay indicates that neither he nor Scott Anderson will be available for the March 27 meeting, I request that <br />this be added as an ite3n on our April lo- agenda. What authority is there in city ordinances for appealing liquor citations to the city manager? <br />3.
