Stat. � 412.651, subd. 9. <br />A city council operating under the Optional Plan B form of government has separate <br />powers and duties. Many of those duties are prescribed by the Uniform Municipal Government <br />Act, Minnesota Statutes chapter 412. However, the powers listed in the Act are not exclusive, and <br />other provisions of law granting additional powers to cities also apply. Minn. Stat. �� 412.211. <br />Relevant to the issue at hand, the Roseville City Council has the following powers and duties: <br />t Exercising the powers and performing the duties of a municipal corporation <br />available under common law. Minn. Stat. � 412.21 l. <br />* Creating departments, divisions, and bureaus for the administration of the affairs of <br />the city as may seem necessary, and from time to time altering their powers and <br />organization. Minn. Stat. �; 412.671. <br />+ Creating and abolishing officers subordinate to the City Manager. Minn. Stat. <br />� 412.681. <br />� Prescribing the duties of offices and combining the duties of various offices as it <br />may deem fit. Minn. Stat. � 412.111; Minn. Stat. � 412.681. <br />� Requiring the Manager to perform the duties of any officer except the treasurer. <br />Minn. Stat. � 412.681. <br />■ Approving regular full-time positions and regular pa t-time positions which are <br />generally expected to continue for more than one year. RSC �� 104.01(D). <br />■ Fixing the compensation of all officers, both appointive and elective, employees, <br />and agents when not otherwise prescribed by law. Minn. Stat. � 412.111. <br />; Establishing by resolution and, from time to time, revising a position classification <br />and pay plan. RSC � 1��� f�<1f ��r�. <br />+ Refraining from dictating the Manager's appointment of any person to office or <br />employment, or in any manner interfering with the Manager or preventing the <br />Manager from exercising judgment in the appointment of officers and employees. <br />Minn.
