REQUEST FOR COUNCIL ACTION <br />DATE: 04/24/06 <br />ITEM: 9. <br />Department ApprovaL• Manager Reviewed: Agenda Section: <br />., � • <br />�. . <br />� �..�'•.��� �,�:.�� <br />� <br />Item Description: Adopt Amendments to Chapter 602 of City Code adding Section 601.OS <br />Relating to Installation and Maintenance of Traffic Control Devices <br />Background: <br />Staff has researched the past practices of determining the need for and placement of traffic <br />control signage in the City of Roseville. State statute designates the Council or governing body <br />as the road authority. Staff has been operating under Resolution 6946, dated April 28, 1980, <br />which delegates the investigation, study, implementation, installation, or other corrective <br />measures for all matters relating to vehicular traffic conditions to the Traffic Safety Committee. <br />Staff discussed this issue with the Council on January 23,2006. The city attorney recommended <br />that the practice outlined in the resolution be codified. The Council concurred and directed staff <br />to return at a future date with an ordinance amending city code. Staff and the City Attorney have <br />drafted an ordinance adding a section 601.OS entitled Traffic Control Devices. (Attachment A) <br />This ordinance captures the intent of Resolution 6946. (Attachment B) This ordinance was <br />discussed with the Council on February 27, 2006. After considerable discussion, the Council <br />referred the proposed ordinance to the Public Works, Environment and Transportation <br />Commission for review and consideration. The PWETC discussed this item at its March meeting <br />and recommended that the ordinance be returned to the Council as recommended <br />The Council also asked for a written opinion from the City Attorney as to the liability issues <br />raised either delegating signage authority to a staff committee or Council retaining this authority. <br />His opinion is attached. (Attachment C) <br />Recommendation: <br />Staff recommends the Council adopt this ordinance and continue the practice of the Traffic <br />Safety Committee studying, implementing, and recommending traffic safety measures that has <br />worked well over the years. Difficult issues would continue to be discussed with the Council as <br />they arise, and hearings would continue to be held in situations that greatly affect neighborhoods. <br />RECOMMENDED COUNCIL ACTION: <br />Motion to adopt an ordinance adding a section 602.05 to City Code entitled "Traffic Control <br />Devices" <br />Prepared By: Duane Schwartz <br />
