City Council Regular Meeting — Q4/10/06 <br />DRAFT Minutes - Page 18 <br />ordinance enforced, with the City Council as the only <br />authority for suspending a license; and the need to enforce <br />current ordinance to send a message that the City Council <br />will not tolerate sales of liquor to minors. <br />Mayor Klausing requested that the advice of City Attorney <br />Anderson be followed, provided sufficient ti�ne to review the <br />issue prior to the City Council took action; opining that by <br />delaying action for a legal opinion didn't mean the Council <br />wasn't tal�ing their responsibility seriously. <br />Councilmember Kough concurred with Councilmember <br />Ihlan's desire to hold a public hearing. <br />Klausing moved, Maschka seconded, tabling the motion until <br />the City Attorney written legal opinion was provided. <br />Roll Call <br />Ayes: Ihlan; Maschka; Pust and Klausing. <br />Nays: Kough. <br />City Attorney Anderson was directed to provide written legal <br />opinion to the City Council further reviewing and <br />determining if significant issues related to due process and <br />double jeopardy may exist after the penalty had already been <br />imposed for those three 2005 liquor violations. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 7:20 <br />p.m. and reconvened at 7:34 p.m. <br />7. Consider the "Quick-Take" Procedure for Already- <br />Condemned Parcels Necessary for Construction of Twin <br />Lakes Boulevard and Other Public Roadways <br />City Development Attorney Rod Krass was present to review <br />the next step in the Twin Lakes Redevelopment project.
