City Council Regular Meeting — OS/08/06 <br />DRAFT Minutes - Page 19 <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided his historical perspective of the current <br />ordinance; and suggested that staff should be providing <br />information, specifically ff�rn the Police Chief in liquor <br />violations, rather than recommendations, not telling <br />Councilmembers what to do. Mr. Kysylyczyn opined that past <br />staff actions were inappropriate and Councilmembers should not <br />rationalize those past actions. <br />Councilmember Pust outlined the purpose of tonight's requested <br />action, in bringing City Code into compliance with State Statute; <br />and her interpretation of the proposed ordinance amendments as <br />being consistent with the City Attorney and Council majority; <br />suggesting that language of the proposed ordinance use "staff," <br />rather than "City Manager" for consistencypurposes; and opined <br />that the City Council would always be the one to malce the final <br />decision under these ordinance amendments. <br />Pust moved, Maschlca seconded, moving ordinance amendment <br />to City Code, Section 302.15, as prepared by the City Attorney, <br />and entitled, "Civil Penalty;" as amended to change language on <br />Page 1, Subsection 302.15B replacing language, "malce a <br />recommendation," to "staff shall provide necessary information," <br />and any references to City Manager throughout the document be <br />changed to "staff." <br />At this point, City Attorney Anderson sought to clarify the <br />version of the draft ordinance being referenced by the City <br />Council; with Mayor Klausing calling a short recess for language <br />verification. <br />Recess Recess <br />Mayor Klausing recessed the meeting at approximately 8:07 p.m. <br />and reconvened at 8:18 p.m. <br />Consider Amendments to the Alcohol Compliance Ordinance1336 <br />Ordinance, continued Amendments to the <br />City Attorney Anderson and Councilmember Pust clarified that, Alcohol <br />with minor amendments suggested at tonight's meeting, the Compliance <br />
