City Council Regular Meeting — OS/08/06 <br />DRAFT Minutes - Page 22 <br />$.a Request of Councilmember Ihlan to Hold Hearings on <br />Alcohol Violations and Penalties for Past Years <br />Ihlan moved, Kough seconded, that the City Council <br />schedule public hearings as required under previous 2005 <br />Roseville Code 302.15 to deterrnine whether mandatory <br />minimum penalties (including one-day license suspensions) <br />should be enforced for 2005 alcohol compliance check <br />failures of three businesses within the community. <br />Councilmember Kough questioned whether it would be <br />appropriate to rescind previous action of the City Manager <br />and renew violations. <br />City Attorney Anderson advised that he would need to <br />further consider that issue before providing a legal opinion. <br />Substantial discussion ensued regarding staff action; the <br />actual offenses and consequences; potential litigation <br />issues; mandatory minimums or presumptive minimums; <br />and Council deviation in individual cases. <br />Further discussion ensued related to minimum mandatory <br />penalties; ordinance interpretation; the alcohol compliance <br />program; education and training programs. <br />Mayor Klausing spoke in opposition to the motion. <br />Further Council debate ensued as Councilmember Ihlan <br />appeared to interpret individual Councilmember intent. <br />Councilmember Ihlan requested a roll call vote on this <br />motion. <br />Public Comment <br />John Kysylyczyn, 3083 N Victoria Street <br />Mr. Kysylyczyn provided his historical perspective of the <br />adoption of the previous liquor compliance ordinance in <br />2000; and disputed various comments made by Mayor <br />Klausing related to rationale for not re-hearing the three <br />2005 non-compliance cases currently under discussion; and <br />opined that the private information should be made public. <br />City Attorney Anderson clarified his rationale for providing <br />Hold Hearings on <br />Alcohol Violations <br />and Penalties for <br />Past Years <br />
