Excerpt from Draf� Minutes flf 5/22/06: <br />CQnsider Ethics Ordinance and Code <br />Mayar Klausing polled Councilmembers as to their preference to discuss <br />this issue tnnight, or hold discussion; and apologized that a strike-out <br />version of the proposed Code had not been provided, but a final proposed <br />draft of either option. <br />Discussion included the two op�ional ver,sians {"Na Consultants" or <br />"Consultants"} provided; revisions by the City Attorney following priar <br />Council discussian and comment and a review of the revisions (5 rather than <br />3 members far the Commission; investigatian language an page 1 to perform <br />other duties; aspirat�onal statements as sugges�ed by the City oi <br />Minneapolis's Code; who would initia�Iy hear complaints and deteranine <br />wheiher an investigation was warranted; outside counsel in the event of a <br />conflict of interesi; and use of position language). <br />Mayor Klausing recammended adoption of the "No Cansultant" versian, <br />opining that consultants occupy di�'ferent positions than elected off cia�s, a��d <br />were hired to provide b�nefit and specifically contracting their services. <br />Councilmember Kaugh spoke in support of the ordinance — with <br />amendments — and apined his preference to have someone other than the <br />City Counci� appoint commissioners; preferred four members of the <br />community and one from outside the community, with one member an <br />attorney; and deie�ion of Item F entitled, "Use of Position." <br />Kough moved, Ihlan seconded, amendment to the Resolution entitled, "A <br />Resolution Adopting a Cade of Eihics," eliminating Item "F" on page 5 <br />entitled, "Use af Posrtion." <br />Mayor Klausing reiterated his rationale for inc�uding the provi�ion. <br />Councilmember Ihlan spake in support of the motion; opining that she didn't <br />have clarity on what it meant to declare a position contrar}r to the City <br />Cauncil. <br />Substantial discussian ensued regarding specific examples; freedom of <br />speech and First Amendment rights; media commen�s and mis-quoting <br />Councilmember comments; advacacy rights and privileges. <br />
