CITY of ROSEVII.LE <br />PLANNED UNIT DEVELOPMENT <br />AGREEMENT #— <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated ,2006, is entered <br />into between the City of Roseville, a Minnesota municipal corporation, of 2660 Civic Center <br />Drive, Roseville, Minnesota 55113 ("CTTY"), and BHJN, LLC, (also lcnown as ACR Homes, <br />Inc.) 2437 Rice Street, Roseville, Minnesota, 55 �� i("DEVELOPER"). <br />1.0 EFFECTIVE DATE of AGREEMENT: <br />This agreement shall he effective upon completion of all of the following: <br />1.1 Execution of this agreement by the CITY and the DEVELOPER. <br />1.2 Recording of this agreement with Ramsey County. <br />2.0 REQUEST £or PUD APPROVAL: <br />The DEVELOPER has requested that the CITY approve an amendment to the 1987 <br />Planned Unit Development (PUD) (PF#3730} to allow greater use of the existing retail <br />strip center at 2435 — 2459 Rice Street. The subject property is legally described as: <br />Lot 1 and Lot 2, Blocic 1 Transit Second Addition, subj ect to drive easement <br />PIN: 12-29-23-14-0089 <br />3.0 PUD APPROVAL: <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />Exhibits A and B in Section 4.0 of this Agreement), subj ect to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits after the effective date of this agreement, if said <br />applications are consistent with this AGREEMENT andlor any plans identified in Section <br />4.0 below. <br />For any improvements proposed thereafter, notwithstanding anything in this <br />AGREEMENT to the contrary, the CITY may require compliance with any amendments <br />to its Comprehensive Guide Plat�, nfficia� controls, �alaf#�ir� or dedication requirements <br />enacted after the date of this AGREEMENT. <br />4.0 APPROVAL by the CITY <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER <br />shall develop the subject property in accordance with these plans. If, however, the plans <br />vary irom the written terms of this Agreement, the written terms shall controL If the <br />plans address items not specifically addressed in this Agreement, the plans shall govern <br />with respect to those items.
