EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 20" day of June, 2006, at 6:00 p.m. The following members were present: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR LA FITNESS IN ACCORDANCE WITH SECTION 1�� OF THE ROSEVII,LE CITY CODE, ALLOWING A 55,000 SQ. FT. HEALTH & FITNESS CLUB AT 2420 CLEVELAND AVENUE (i'F375$} WHEREAS, LA Fitness has requested a CONDITIONAL USE PERMIT in accordance with Section 1013 of the Roseville City Code to allow a health �; fitness club on properiy addressed at 2420 Cleveland Avenue; and WHEREAS, the properiy 2801 Snelling Avenue is legally described as: ATTACHED PIN 09-29-23-32-OOQ3 WHEREAS, Section 1005.015 allows a health & fitness center as a CONDITIONAL USE within the B-2, Retail Business District; and WHEREAS, Section 1013.01 establishes specific criteria to be reviewedlsup�ortee3 with ail CONDITIONAL USE PERMITS: and WHEREAS, the proposal by LA Fitness seeks to redevelop the properiy into a 55,000 sq. ft, fitness center and other associated site improvements; and WHEREAS, the Planning Commissionheld a public hearing on June 7,2006 concluding that the proposal is consistentwith the criteriaof Section 1013 of the Roseville City Code; WHEREAS, the Planning Commission voted (7-0) to recommend approval of the request, subj ect to 12 conditions. NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant a CONDITIONAL USE PERMIT to LA Fitness allowing the redevelopmentof the properiy at 2420 Cleveland Avenue, based on the findings of Section 5 of the project report dated June 20, 2006 and subject to the following conditions:
