City Council Regular Meeting— 06/12/06 <br />DRAFT Minutes - Page 17 <br />Roll Ca��. <br />Ayes: Kough and Ihlan. <br />Nays: Pust; Maschka and Klausing. <br />Motion failed. <br />Kough moved, Ihlan seconded, that language be amended that <br />the Ethics Commission do its own investigations, not the City <br />Attorney or the City Manager, due to potential conflicts of <br />interest issues. <br />Councilmember Kough spoke in strong support of the motion. <br />Councilmember Ihlan opined that the independence of the Ethics <br />Commission was very important, but that she could be persuaded <br />on their roles; but was troubled by taking investigatory authority <br />away from the Ethics Commission; and would prefer additional <br />study by the Task Force and Professor Schultz; however, at this <br />time she was supportive of ih� amendment. <br />Councilmember Pust opined that she felt strongly in the <br />opposite; that what was done in the past was inappropriate; and <br />since investigations included private information, it should not <br />be in the hands of appointed citizens, but in the hands of trained <br />professionals, well-versed in employment operations; data <br />privacy restrictions; and spoke in strong support of the proposed <br />language, and in opposition to this proposed amendment. <br />Roll C all <br />Ayes: Kough and Ihlan. <br />Nays: Pust; Maschka and Klausing. <br />Motion failed. <br />Kough moved to reinstate old language provisions (referenced as <br />Section 3.r) related to Elected Officials not exceeding their <br />authority. <br />Mayor Klausing ruled the motion out of order, noting that it had <br />been voted down at the last meeting. <br />Councilmember Ihlan appealed the motion of the Chair. <br />
