Gillen, General Manager Green Mill Restaurant and Bar 145 Roseda.l.e Center Roseville, MN 55113 Re: Liquor License Dear Mr. Gill�n, This is my response to your appeal from the Police Chiefs August �� notice informing you of your failure to pass an alcohol compliance check. My response is based upon the entire record in this case, including the hearing on Tuesday, September ��ik_ �ased on that record, I znake the following findings of facts. On August 12,2005, your employee, Roxanne Cossny Loth, was cited by the Roseville Police Department for serving alcohol to an under-aged individual. Green Mill does not contest the fact that this violation took place. Your server did indeed provide alcohol to a minor. Accordingly, the Police Chief sent you a notice fining you $500 and suspending your liquor license for one-day. This is the penalty prescribed under the Roseville City Code. (Your establishment did not qualify for a lesser sanction under the City Code because you do not participate in the City's Optional Manager and Server Training Program. Participants in that Program are subject to lesser sanctions for liquor violations in return for licensees carrying out a robust and aggressive liquor training program for each employee who serves alcohol.) At the hearing you presented certain in%rma�inri in mitigation of the violation. Specifically, you explain that the server in question has paid her fine and received a formal written warning about serving under-age persons. In addition, you have retrained your front-a� the-store staff. Finally, you indicate a desire to do more training. For the following reasons, I have decided to accept the mitigation testimony: + Your demeanor at the hearing suggests to me that you take your liquor serving duties very seriously; * You acknowledge that serving alcohol to minors is a serious offense; and
