Request of Councilmember Ihlan: Consider Hiring <br />��� Independent Outside Counsel to Review Twin Lakes Court <br />Ruling <br />Ihlan moved, Kough seconded, authorizing that the City Council <br />hire independent, outside Counsel to analyze the implications of <br />the Court of Appeal's decision for the future of the Twin Lakes <br />development, including impacts on the Development Contract; <br />Tax Increment Financing Subsidies; ongoing Eminent Domain <br />proceedings; the Twin Lakes Parkway; and updates to the <br />AUAR. <br />Councilmember Ihlan spoke in support of the motion, opining <br />the complexity of the issues involved; and the need for legal <br />Counsel not actively involved in advising the City at this time in <br />order to provide objective advice. <br />Councilmember Pust noted the specialized nature of the case. <br />City Attorney Anderson confirmed that the City had originally <br />received a roster of five qualified firms from the LMCIT. <br />Mayor Klausing expressed concern regarding additional legal <br />fees, and the hours necessary in reviewing the matter from <br />initiation. <br />Ihlan amended, Kough seconded, modifying the motion to move <br />that the City Council obtain a list of qualified firms from the <br />LMCIT, with the intention of hiring independent, outside <br />Counsel. <br />Councilmember Pust spoke in support of the modified motion; <br />opining that it would represent a minimum investment to obtain <br />names and make phone calls to determine if billing would be <br />done on a project or billable-rate basis, to allow for further City <br />Council discussion. <br />Mayor Klausing concurred, opining the difficulty in providing an <br />estimate of billing and reasonable estimated costs without doing <br />extensive preliminary review of the case on a billable basis. <br />Mayor Klausing questioned whether formal action was required; <br />Councilmember <br />Ihlan: Consider <br />Hiring Independent <br />Outside Counsel to <br />Review Twin Lakes <br />Court Ruling <br />
