REQUEST FOR COUNCIL ACTION <br />DATE: 09118/06 <br />ITEM: Z. <br />Department Approval: Manager Reviewed: Agenda Section: <br />�,—�- � �. <br />., � <br />r��' �' <br />__ - � �}�, <br />Item Description: Erosion Control Ordinance <br />Background: <br />Since 2003, the City of Roseville has had a permit to operate as an MS4 (municipal separate <br />storm sewer system) city in the MPCA stormwater program. Under this Federally mandated <br />stormwater program, MS4s are required to develop and implement a Stormwater Pollution <br />Prevention Program (SWPPP). The SWPPP must cover six minimum control measures: <br />■ Public education and outreach; <br />■ Public �articipationlinvolvement, <br />Illicit discharge, detection and elimination; <br />■ Construction site runoff control; <br />■ Post-construction site runoff control; and <br />Pollution pr�veniio�/good housekeeping. <br />The MS4 must identify best management practices (BM�'s) and measurable goals associated with <br />each minimum control measure. As required by our permit, we submit an annual report to the <br />MPCA on the implementation of the SWPPP each spring. <br />One action the City of Roseville is taking to meet these requirements is to implement an erosion <br />Control permit. The Council approved the fee structure for the new permit last winter and we <br />have been issuing them this year. <br />Discussion: <br />In enforcing the permits, we have found that our current erosion control requirements are <br />scattered throughout various sections of the City Code. Relocating all of these references to one <br />section of the code would ease and improve the implementation and enforcement of these <br />permits. As a result staff recommends that we work to develop and adopt an updated erosion and <br />sediment control (ESC) ordinance, which would address construction site runoff controls. <br />Attached is a draft erosion control ordinance that has been reviewed by the city attorney and the <br />Public Works Environment and Transportation Commission. We have also attached excerpts <br />from the existing code with erosion control references highlighted.
