EXTRACT OF MINUTES OF MEETING OF THE <br />C�'�`X COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Rarr�sey, Minnesota, was held on the 9t�' day of October, 2006, at 6:00 p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A VARIANCE TO ��OU4.U�6 AND I N ACCORDANCE <br />WITH ��,Oa,3.02 OF T H E ROSEVILLE CITY CODE FOR CHARLES WELECZHI, <br />AND THE VACANT PARCELAT DALE STREET AND DALE COURT (�'F37$1). <br />WHEREAS, Charles Weleczki is the owner of the vacant developable parcel at Dale <br />Street and Dale Court; and <br />WHEREAS, the subject property is legally described as: <br />REQUIRES LEGAL DESCRIPTION <br />WHEREAS, the property owner seeks a 15 foot VARIANCE to $1004.016 (Residential <br />Dimensional Requirements —Front Yard Setback) to allow greater flexibility in the design of a <br />principal structure on the uniquely shaped parcel at Dale Court and Dale Street; and <br />WHEREAS, The Roseville Variance Board held the public hearing regarding the <br />VARIANCE request, voting 3-0 to DENY based on their determination that "hardships" were <br />not present and that the need for the variance was created by the applzcaz��/prope�ty owner; and <br />WHEREAS, the applicant has appealed the decision of the Variance Board to the <br />Roseville City Council seel�ing the Council's support for the requested 15 front yard setback <br />VARIANCE; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the request by Charles Weleczl�i for a 15 foot VARTANCE to $1004.016 (Residential <br />Dimensional Requirements —Front Yard Setback) in accordance with Section $1013.02 of the <br />Roseville City Code, subject to the following conditions; <br />�o The encroachment being limited to 15 feet from the front property line adjacent to <br />Dale Court. <br />2. The design of any homelattached garage must minimize the impact of the <br />encroachment— be designed in such a manner that the homelattached garage are <br />positioned angular (not 90%) to Dale Court. <br />
